1. Operator, property, and scope
NextTradition LLC, a Florida limited liability company (“Operator”), operates Rivulet Farm in Tampa, Florida. The real property is personally owned separately from the LLC. “Protected Parties” means the Operator, the property’s individual legal owner or owners, and their respective members, managers, employees, and authorized agents acting in connection with the rental. Individual owners and any additional protected parties must be identified in the signed rental agreement or release.
These terms address farm house stays, event-space rentals, and separately booked outdoor batting cage use. The applicable signed agreement identifies the permitted areas, activities, participants, and services. No person is authorized to bind another adult to a personal-injury release merely by reserving for a group.
2. Booking and agreement
An inquiry, website listing, or discussion is not a reservation. Confirmations, dates, prices, deposits, capacity, check-in and check-out, cancellations, refunds, weather arrangements, and any insurance requirements must be set out in the accepted rental agreement or applicable booking-platform terms. No additional fee, refund restriction, or insurance amount is established by implication on this page.
Where these terms are expressly incorporated into an accepted booking, mandatory law and applicable platform requirements control; rental-specific terms govern the subjects they specifically address. Changes to website terms do not retroactively change an already accepted booking without the required agreement.
3. Renter and organizer responsibilities
The renter must be an adult with authority to arrange the rental, provide accurate information, use only approved spaces and activities, observe capacity and time limits, and communicate use rules to guests and vendors. Renters are responsible, to the extent legally enforceable and within their control, for their own conduct and the conduct of invitees and vendors they bring onto the property, including resulting damage, unauthorized use, and cleanup obligations specified in the agreement.
Organizers must arrange responsible supervision, including continuous adult supervision of children, and obtain any permits, vendor approvals, or insurance required by the accepted agreement or law. No childcare, lifeguarding, coaching, officiating, or medical supervision is included unless expressly agreed in writing. Participation under the influence of alcohol or drugs, dangerous play, tampering with safety equipment, and use of closed areas are prohibited.
4. Risks across all three rental options
Outdoor and recreational activities involve risks that can result in property loss, serious injury, disability, or death. Risks include uneven or slippery ground, roots, steps, falling branches, insects, wildlife, heat, lightning, weather, creek banks and water, vehicles, equipment, and other people’s conduct. Conditions can change. A scenic or private setting is not a guarantee of safety.
- Farm house: stairs or changes in level, wet surfaces, furnishings, appliances, the lanai, and unfamiliar surroundings require care. Follow occupancy and house rules and use facilities only as intended.
- Events: crowds, setups, decorations, temporary equipment, food or alcohol supplied by organizers or vendors, and guest conduct can create risks. Obtain approval for layouts, vendors, and any special activities.
- Batting cage: balls, bats, ricochets, swings, netting, and equipment can cause severe injuries. Use suitable protective equipment and the safety rules specified for the activity. Do not enter an active batting area, swing toward bystanders, or use visibly damaged equipment or netting. A net covering is not a weatherproof shelter.
Use only areas and activities approved for the rental. Do not enter the creek or other restricted areas without express permission. Stop an activity if conditions appear unsafe; report hazards and incidents promptly. In an emergency, call 911. Anyone unable to participate safely should decline or stop participation.
5. Assumption of risk and adult release
WHEN EXPRESSLY ACCEPTED IN A SEPARATE SIGNED ADULT RENTAL AGREEMENT OR PARTICIPANT RELEASE: To the fullest extent Florida law permits, the signing adult voluntarily assumes the risks of their use of the agreed premises and activities, including known and unknown risks, and releases the Protected Parties from claims by that adult for personal injury, death, or property damage arising from that use, including claims caused in whole or in part by a Protected Party’s ordinary negligence.
This proposed release does not include gross negligence, willful or wanton misconduct, intentional wrongdoing, or any duty, claim, remedy, or liability that applicable law prohibits releasing. It does not bind non-signing guests or purport to waive a minor’s rights through an adult’s general booking.
A separate release must clearly identify the parties, activities, and risks, be presented before participation, and be knowingly accepted. This webpage alone is not evidence of that acceptance.
6. Minors
Children require responsible adult supervision. Any minor participation release must be a separate document executed by a legally authorized natural guardian and must satisfy Florida’s requirements, including the scope and conspicuous notice required by section 744.301(3), where applicable. A blanket waiver of all injuries to children is not established by these terms. The operator may decline participation when a required valid release has not been obtained.
7. Indemnity and responsibility for third-party claims
When expressly accepted in the signed rental agreement, and only to the extent permitted by law, the renter agrees to indemnify and hold harmless the Protected Parties from third-party claims, damages, and reasonable defense costs, including reasonable attorney fees, to the extent caused by the renter’s breach, negligent or wrongful acts, unauthorized activities, or the acts of guests or vendors for whom the renter is legally responsible. This obligation does not require indemnification for a Protected Party’s own negligence, gross negligence, intentional misconduct, or a nonwaivable legal duty. Any broader allocation must be separately reviewed and expressly agreed.
8. Limits on recoverable losses
To the extent permitted by law and expressly accepted in the signed rental agreement, the Protected Parties are not responsible for indirect or consequential economic losses such as lost profits, travel costs, missed opportunities, or third-party event expenses arising from the rental. For an ordinary contract or service claim, the agreed liability cap is the amount paid to the Operator for the affected rental. These limitations do not cap bodily-injury or death claims, statutory remedies that cannot be limited, refunds required by law or binding platform terms, or liability for gross negligence or intentional misconduct.
Personal belongings remain the guest’s responsibility; no custody or safekeeping service is undertaken unless agreed. Nothing here excuses liability that the law does not allow to be excluded.
9. No absolute safety, seclusion, or service guarantee
The website describes the farm but does not guarantee uninterrupted availability, weather conditions, complete seclusion, or freedom from injury, interruption, or third-party conduct. Exclusive access must be stated in the rental agreement. Website information may contain errors; material rental details must be confirmed before booking. No disclaimer overrides an express contractual promise or mandatory consumer, lodging, privacy, or safety obligations.
Personal information is addressed in the Privacy Policy. There is no promise of absolute data security, but applicable data-protection duties remain in force. This is not consent to unlawful surveillance, misuse of personal information, or intrusion into private spaces.
10. Suspension and unsafe conditions
The Operator may pause unsafe activity or require a person to stop prohibited conduct. Any termination, rescheduling, or refund is governed by the accepted rental agreement, applicable platform requirements, and law. No weather or safety interruption creates an automatic forfeiture of payment under this webpage alone.
11. Florida law and disputes
To the extent validly agreed and not displaced by mandatory law or binding booking-platform terms, Florida law governs the rental relationship and disputes will be brought in courts of competent jurisdiction in Hillsborough County, Florida, or the federal court serving that county. These terms do not impose mandatory arbitration or a jury-trial waiver. A party may use any forum or procedure that applicable law requires be preserved.
12. Severability and limits of these protections
If a provision is unenforceable, the remaining valid provisions continue to the extent permitted by law. No term eliminates all possible liability, creates immunity merely because the property is called a farm, or replaces required permits, maintenance, insurance, or statutory signs. Any agritourism protection depends on actual legal eligibility and compliance, not the label used on this website.
